The Platform is operated by Ruth Oneya Illustrations LLC, doing business as Art Gola ("Art Gola", "we", "us", "our"). By accessing or using Art Gola (the "Platform"), creating an account, or purchasing a membership, you agree to be bound by these Terms of Service, the Art Gola Payment Terms, and the Art Gola Privacy Policy, each as updated from time to time. At checkout, you must affirmatively indicate your agreement to these policies before completing your purchase. If you do not agree, you may not create an account, purchase a membership, or use the Platform.
Art Gola is intended for adults. You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to create an account, purchase a membership, or use the Platform. By creating an account or using Art Gola, you represent and warrant that you meet these eligibility requirements. Art Gola is not directed to children. We may suspend or terminate any account that does not satisfy these requirements.
Subject to these Terms, Art Gola grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose: discovering, evaluating, and contacting live event artists, or maintaining an artist profile as a member. You may not copy, reproduce, republish, sell, or exploit any portion of the Platform or its content except as expressly permitted by these Terms or with Art Gola's prior written consent. This license ends when your access is terminated or these Terms are no longer in effect.
Artists are responsible for keeping their profile information, portfolio images, service descriptions, availability information, experience, pricing information, ratings, reviews, and other submitted information accurate, current, and not misleading. Art Gola may review, approve, reject, edit, hide, suspend, or remove a profile or submitted content when reasonably necessary to protect the Platform, enforce these Terms, respond to complaints, or maintain the quality and integrity of the directory.
Portfolio artwork must be the artist's own original, human-created work and may not be generated by artificial intelligence (AI). Art Gola may reject, hide, or remove artwork or portfolios that violate this requirement and, where appropriate, may suspend or remove an artist from the directory. Ordinary editing of a photograph of genuine human-created artwork, such as cropping, exposure or color correction, resizing, or similar presentation edits, does not by itself make the underlying artwork AI-generated.
Artists retain ownership of the original artwork and images they submit. By uploading or submitting content to Art Gola, an artist grants Art Gola a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, and distribute that content solely as reasonably necessary to operate, promote, and improve the Platform and the artist's profile. For clarity, this license allows Art Gola to do things like display your work on your profile and in search results, resize and format images for different screens, and feature your work in Art Gola's own marketing, such as its social media or blog, with credit to you where practical. It does not allow Art Gola to sell your artwork, license it to third parties for their own use, or create products from it. The license ends for content you delete, except for copies retained in routine backups for a limited period. The artist represents that they own the submitted content or have all permissions necessary to grant this license.
Art Gola is a directory and connection platform that helps visitors discover independent artists. Art Gola is not an artist, booking agent, employer, representative, insurer, payment intermediary, or party to any contract, booking, service agreement, payment, refund, cancellation, or dispute between an artist and a client.
Artists and clients are solely responsible for communicating with one another, evaluating suitability, negotiating terms, entering into their own contracts, collecting or making payments, obtaining appropriate insurance, fulfilling services, resolving disputes, and complying with applicable laws. Art Gola does not guarantee the identity, availability, conduct, pricing, qualifications, work quality, performance, reliability, or legal compliance of any artist or client.
Search results are designed to help visitors discover relevant Artists. An Artist is shown in search results only when their profile is published and visible, their membership is active or they have complimentary access, their profile meets our minimum profile requirements (including a profile photo and the minimum number of Portfolio images), and they match every filter the visitor has selected. Artists who do not meet these requirements, or who do not match a selected filter, are not shown in those results.
Among the Artists shown, ordering may consider factors such as location, travel distance, experience, completed events, ratings and reviews, pricing, Availability information, and the sort option the visitor chooses. When a visitor searches for a specific date, Artists who have not provided Availability for that date may still be shown, while Artists who have marked themselves unavailable on that date are not.
Art Gola may change how search results are organized at any time. Membership does not guarantee any particular ranking, placement, number of views, inquiry volume, booking volume, or visibility.
Artist memberships are billed on a monthly basis as described in the Art Gola Payment Terms, which are incorporated into these Terms by reference. Payments are processed through Stripe, our third party payment processor. By purchasing a membership, you agree to the Payment Terms, including the provisions governing automatic monthly renewal, cancellation, failed payments, refunds, and price changes.
Cancelling a membership and deleting an account are different actions. Cancelling a membership stops future membership billing but does not automatically delete the account or its associated information. Unless otherwise stated in the Payment Terms, a cancelled membership remains active through the end of the already paid billing period.
You may request deletion of your account through your account settings. When you confirm deletion, your profile is removed from public view, any active membership ends, no further membership charges are made, and you will be signed out. We will delete or anonymize your associated personal information from our active systems within thirty (30) days, in accordance with our Privacy Policy. Once the deletion request has been processed, it cannot be undone.
We may retain limited information where required by law or reasonably necessary for legitimate business purposes, including tax, accounting, fraud prevention, security, dispute resolution, enforcement, and records maintained by our payment processor. If you delete your account while a membership is active, your access ends immediately and fees already paid are not prorated or refunded, except where required by law. If you want to keep access through the end of your paid billing period, cancel your membership first and delete your account after the period ends.
You may not use the Platform to violate any law; infringe another person's intellectual property, privacy, publicity, contractual, or other rights; submit false, deceptive, defamatory, threatening, abusive, discriminatory, obscene, or unlawful content; impersonate another person or misrepresent an affiliation; interfere with the security or operation of the Platform; gain unauthorized access to accounts, systems, or data; introduce malware or harmful code; use bots, crawlers, scrapers, data mining tools, or other automated means to access, copy, collect, monitor, or extract Platform content without written permission; copy or compile artist information for a competing directory or commercial database; evade account restrictions; or use the Platform in a way that could damage Art Gola or other users.
Art Gola may investigate suspected violations and may remove content, restrict access, suspend or terminate accounts, and take other reasonable action to protect the Platform and its users.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Art Gola and its owners, officers, employees, contractors, affiliates, service providers, and agents from and against third party claims, demands, actions, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising out of or relating to: (a) your use or misuse of the Platform; (b) your content, profile, services, conduct, or transactions with another user; (c) your breach of these Terms or any incorporated policy; or (d) your violation of any law or the rights of another person.
Art Gola may assume control of the defense of a claim subject to indemnification, and you agree to reasonably cooperate with that defense. You may not settle such a claim in a manner that imposes liability or obligations on Art Gola without Art Gola's prior written consent.
The Platform and all content, listings, and services made available through it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Art Gola does not warrant that the Platform will be uninterrupted, secure, or error free, that defects will be corrected, or that any listing, profile, rating, or other content is accurate, complete, or reliable. Inclusion of an artist in the directory is not an endorsement, certification, or guarantee of that artist by Art Gola.
To the fullest extent permitted by law, Art Gola and its owners, officers, employees, contractors, affiliates, service providers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or opportunities, arising out of or relating to the Platform or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by law, the total aggregate liability of Art Gola for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of the membership fees you paid to Art Gola in the twelve (12) months before the event giving rise to the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you. This section does not limit any non-waivable rights you may have under applicable law.
These Terms are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Alabama, and each party consents to the personal jurisdiction of those courts. If the law of the place where you live grants you non-waivable consumer protection rights, or a non-waivable right to bring claims in your local courts or under your local law, nothing in this section takes away those rights.
Art Gola may update these Terms from time to time. When required by law or when a change is material, we will provide reasonable notice through the Platform, by email, or by another appropriate method. The updated Terms will state the date they became effective. Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
